NOTARIAL SERVICES MELBOURNE

When your documents need to be recognised overseas, you need proper legal certification backed by the authority of a Notary Public. At Costanzo Lawyers, we provide professional notarial services in Melbourne to individuals and businesses requiring documents verified for international use.

HOW A NOTARY PUBLIC HELPS YOU

A Notary Public is a senior legal professional authorised to verify, witness, and certify documents for international use. Unlike a Justice of the Peace, a Notary’s seal and signature are officially recognised in foreign countries.

Our principal, Frank Costanzo, is an experienced Solicitor and Notary Public whose signature and notarial seal are registered with the Department of Foreign Affairs and Trade (DFAT). This enables clients to obtain an Authentication or Apostille Certificate if required.

A Notary Public can:

  • Verify your identity before witnessing signatures
  • Certify true copies of documents (e.g. passports, academic records, company documents)
  • Prepare and witness international powers of attorney
  • Notarise affidavits, declarations, and certificates for use abroad
  • Certify business or property-related documents for foreign transactions

FAQs

What’s the difference between a Notary Public and a Justice of the Peace?

A Justice of the Peace (JP) can certify documents for use within Australia. A Notary Public, however, has international authority. Documents certified by a JP are not valid overseas, while notarial acts are recognised globally.

Do I need an Apostille or Authentication after notarisation?

If your documents are being sent overseas, some countries require an Apostille or Authentication Certificate from DFAT after notarisation. We’ll advise you on what’s needed based on your destination country.

Can any lawyer perform notarial services?

No. Only lawyers specifically appointed as Notaries Public can perform notarial acts. Not all lawyers hold this qualification or have an official notarial seal registered with DFAT.

Can I have my documents certified at the post office instead?

No. Post office certifications are only valid in Australia. For documents used overseas, notarisation by a registered Notary Public is required for recognition by foreign authorities.

How much does notarisation cost?

Notarial fees depend on the document type and complexity. Costs vary between practitioners, so we always provide a transparent quote before your appointment. We’ll always discuss costs upfront so you know exactly what to expect, no hidden fees.

Can I sign the documents before my appointment?

It’s best not to sign documents beforehand. The Notary Public must witness your signature in person to confirm identity and ensure proper legal execution.
